Mayor Amante Supports LCP Protest Against SC Flip Flopping of Cityhood Case

March 10, 2011 BUTUAN – “I will not mourn because Cabadbaran and two other cities in Caraga are converted into cities, because I want them to also improve, but I support the move of the League of Cities of the Philippines (LCP) to protest against Supreme Court’s (SC) flip-flopping on the cityhood controversy.” This is the stand of Mayor Ferdinand Amante Jr., who will be announcing what action to be taken by the city government of Butuan signifying its support of the Monday’s scheduled launching of a grassroots-based information and education campaign to drum up the SC’s flip flopping. Mayor Amante said that the flip flopping decision of the SC blemished the credibility of the High Tribunal. He also pointed out that he is not against to the reduction of internal revenue allotment of the city government of Butuan as a result of the conversion saying, “certain adjustments have to be made as a sacrifice for the good of the whole region and to the country as well.” On Monday, March 14, Mayors in different cities all over the country will synchronize actions of protest such as having a noise barrage, wearing of arm bands, flags on half mast, city halls closed to be manned only by skeletal force to attend basic transactions, and the wearing of t-shirt marked SPUR, that stands for S for Stop illegal conversion of municipalities, P for Protect local government code, U or Uphold the rule of law and R for Respect the constitution. LCP likewise encouraged the Sanguniang Panlunsod to pass resolutions condemning the decision of the SC. In 2007, Congress enacted laws for the cityhood of 24 municipalities however in November 2008, the SC declared the cityhood laws as unconstitutional. Then SC reversed its first decision in December 2009 after hearing the motion for reconsideration filed by concerned mayors. But then again in August 2010, the High Court ruled that the cityhood laws are unconstitutional. Last month, the SC again reversed its former decision and re-declared the cityhood laws as constitutional. In the process of litigation, eight municipalities withdrew their intentions to be converted. The remaining 16 are: Baybay (Leyte), Bogo (Cebu), Catbalogan (Samar), Borongan (Eastern Samar), Tandag (Surigao del Sur), Bayugan (Agusan del Sur), Cabadbaran (Agusan del Norte), Mati (Davao Oriental), Lamitan (Basilan), El Salvador (Misamis Oriental),Tayabas (Quezon province), Tabuk (Kalinga), Batac (IlocosNorte), Guihulngan (Negros Oriental), Carcar (Cebu) and Naga.
